This Privacy and Cookies Policy is meant to inform you of how we handle the data you provide us during registration, or data that can be generated when using the Solution.
Using the Solution implies acceptance of this Privacy and Cookies Policy.
The owner of the Solution reserves the right to modify this Privacy and Cookies Policy at any time, notifying users of any changes, and it will take effect from the date indicated.

SIMON, S.A. (hereinafter “SIMON”) with Tax ID number A-08078651, with registered office at Diputación 390-392, 08013, Barcelona, is responsible for processing the personal data your provide us during registration, as well as data generated when using the Solution.
SIMON has appointed a Data Protection Officer, whom you can contact at any time with questions regarding the processing of your data, via email at dpo.app@simon.es or at the mailing address indicated.
To sign up for the Solution, you must first register as a SIMON user by filling out a registration form that will request personal data. You will need to provide an email address, which will be your ID, and generate a password, which you must carefully protect so it is not disclosed to other people.
You are responsible for guaranteeing that the personal data you provide is true and accurate. SIMON reserves the right to block any user that provides false data, Legal actions notwithstanding. In no case should you register third-party data.
Data provided by the user during the registration process
To register as a SIMON user and user of the app, you are required to provide us with personal data. For the service to function, you must provide us with all the necessary data, except in cases when it is marked optional.

Additionally, if you expressly consent during the registration process, your data may be processed in order to send you commercial communications, by any means, about news, information, offers and promotions of services offered by SIMON Group companies or third parties. We will not share your data with third parties for this purpose because the information will be sent to you by SIMON.
The legal basis for sending commercial communications is your consent, formalized during the registration process by ticking the corresponding box.
Data collected through use of the Solution
For the app to function and so that you can use the functionalities of the Solution, the installation will collect and transmit data such as the following to SIMON:

You are also informed that, in the event of malfunctions, the Solution will automatically collect technical data from the devices in order to correct and improve the Solution. In this event, the Solution will only collect technical information. No type of personal information will be collected.
Your data will only be accessed by SIMON personnel to execute tasks related to R&D, development, exploitation, management, user support service, resolution of Solution incidents and, where appropriate, marketing.
They may also be accessed by our service providers. We may contract specific services from third parties that could require them to access and/or process your personal data, acting as parties responsible for processing, but in any case, the adequate guarantees have been established such that said third parties are required to comply with applicable laws and with our security policies. They must guarantee that they will use the information in keeping with the instructions of SIMON and must implement suitable technical and organisational measures to ensure the confidentiality of the information.
Your personal data will be kept until you decide to unsubscribe as a SIMON user. You can unsubscribe by sending an email to dpo.app@simon.es. If you do so, your user will be deleted, but the data of your connected products will be stored until the product is reset, or for as long as there is a SIMON user account associated with the product.
Remember that if you unsubscribe from SIMON, you will lose access to all the services that SIMON offers.
We also offer you the option to block your account, so that you can reactivate it later if you’d like. This option does not involve deleting your data.
If you are a user from a country in the European Economic Area, we inform you that your data will be stored on servers located in Europe.
If you are a user from a country with specific data protection legislation that requires personal data to be stored in its jurisdiction, your data will be hosted on servers in the country (e.g. Russia, Morocco, Brazil or Mexico).
SIMON is committed to information security and has laid out security policies and procedures to ensure the confidentiality of your data.
You are reminded that if you are using a rooted (Android) or jailbroken (iOS) mobile phone, SIMON cannot be held responsible for the operation of the Solution or the integrity or confidentiality of your personal data, and is totally exonerated from any liability.
If you wish, you can subscribe to services provided by third parties. Such subscription will be subject to acceptance of the specific conditions of use and the privacy policy of the third party. In this case, you will be informed and accept that SIMON does not have any control or responsibility over the data processing performed by third parties.
You may exercise your rights of access, rectification, deletion, opposition, limitation of treatment or portability at any time, as well as revoke the consent granted when appropriate, according to the provisions of current regulations.
To do this, you can contact SIMON at the mailing address indicated, or via an email to the Data Protection Officer dpo.app@simon.es.
If you otherwise believe that a breach of data protection legislation has occurred regarding the processing of your data, you may file a complaint with the Spanish Data Protection Agency.
Cookies (pixels and other technologies) are small files installed in the terminal accessing the app. They store certain information for purposes described below.
